MERIT and the Drug Court: Treatment-Based Alternatives to Prison in NSW

Many people facing a drug possession or supply charge assume the only options on the table are a fine or a prison sentence. NSW actually has programs built around treatment rather than pure punishment, and two names come up most often: MERIT and the Drug Court. They are related in purpose but quite different in how they work.

What Is MERIT?

MERIT — Magistrates Early Referral Into Treatment — is a voluntary program available through many NSW Local Courts. It connects an eligible defendant with drug and alcohol treatment before their matter is finalised, rather than waiting until sentencing to address the underlying issue. It’s a pre-plea, pre-sentence program: participation doesn’t decide your case, but the court can weigh how you engaged with it when it eventually comes to sentencing.

Not every Local Court runs MERIT, and eligibility is assessed case-by-case by the court and program staff. We want to confirm the current referral process and precise eligibility criteria before stating them in detail here — if MERIT may be relevant to your matter, ask us directly and we’ll advise on your specific court and circumstances.

What Is the NSW Drug Court?

The Drug Court is a dedicated court that deals with matters where drug dependency is directly connected to the offending. Rather than a standard sentencing process, it combines judicial supervision, structured treatment, and case management as a genuine alternative to a full-time custodial sentence, for people whose circumstances make them suitable for that pathway.

As with MERIT, we want to confirm the exact referral pathway and eligibility criteria for the Drug Court before setting them out here in detail — this is a question we can answer precisely for your specific circumstances.

How the Two Differ

At a general level, MERIT operates through the ordinary Local Court process as an early, voluntary treatment referral available to a broad range of defendants. The Drug Court is a separate, dedicated court altogether, generally reserved for more serious or entrenched matters where imprisonment is a real prospect and drug dependency is a central driver of the offending.

Does Participating Guarantee a Better Outcome?

No. Successful participation in MERIT or the Drug Court is one factor a court can weigh in your favour — it is not a guaranteed pathway to a lesser penalty or a non-conviction outcome, and neither program is available in every case. What it does provide is genuine, documented evidence of engagement with treatment, which experienced representation can present effectively at sentencing.
